Imagine you are walking through a park. Suddenly, a mugger points a gun at you, threatening to shoot you if you do not hand over your valuables. Is this an instance of domination? Many authors working within the neo-republican framework - including Philip Pettit himself - are inclined to say 'yes'. After all, the mugger case seems to be a paradigmatic example of what it means to be at someone's mercy. However, I argue that this conclusion is based on a (...) misleading, interactional account of domination that misconceives its structural character. Domination, I maintain, is a structurally constituted form of power. Whether the mugger in the park dominates you or not can only be established by analysing the wider power structures in which your interaction is embedded. (shrink)

Abstract: The article aims to sharpen the neo-republican contribution to international political thought by challenging Pettit’s view that only representative states may raise a valid claim to non-domination in their external relations. The argument proceeds in two steps: First I show that, conceptually speaking, the domination of states, whether representative or not, implies dominating the collective people at least in its fundamental, constitutive power. Secondly, the domination of states – and thus of their peoples – cannot be justified normatively in (...) the name of promoting individual non-domination because such a compensatory rationale misconceives the notion of domination in terms of a discrete exercise of power instead of as an ongoing power relation. This speaks in favour of a more inclusive law of peoples than Pettit (just as his liberal counterpart Rawls) envisages: In order to accommodate the claim of collective peoples to non-domination it has to recognize every state as a member of the international order. Conceptualism is the view that at least some perceptual representation is conceptual. This paper considers a prominent recent argument against Conceptualism due to Ned Block. Block’s argument appeals to patterns of color representation in infants, alleging that infants exhibit categorical perception of color while failing to deploy concepts of color categories. Accordingly, the perceptual representation of color categories in infancy must be non-conceptual. This argument is distinctive insofar as it threatens not only the view that all perception is conceptual, but (...) also views that restrict the Conceptualist thesis to perceptual categorization. However, I contend that it fails at two stages. Block’s arguments for the perceptual representation of color categories in infancy, and against color concept deployment in infancy, are unpersuasive. Thus, Block has not vanquished Conceptualism. I draw out implications for debates about the perception-cognition border and for the question of whether explicit categorization occurs in perception. This introductory chapter provides an overview of the chapters making up the book, which are grouped into six sections: challenges and alternatives to the causal theory of memory; activity and passivity in remembering; the affective dimension of memory; memory in groups; memory failures: concepts and ethical implications; and the content and phenomenology of episodic and semantic memory.

The scientific community, we hold, often provides society with knowledge—that the HIV virus causes AIDS, that anthropogenic climate change is underway, that the MMR vaccine is safe. Some deny that we have this knowledge, however, and work to undermine it in others. It has been common to refer to such agents as “denialists”. At first glance, then, denialism appears to be a form of skepticism. But while we know that various denialist strategies for suppressing belief are generally effective, little is (...) known about which strategies are most effective. We see this as an important first step toward their remediation. This paper leverages the approximate comparison to various forms of philosophical skepticism to design an experimental test of the efficacy of four broad strategies of denial at suppressing belief in specific scientific claims. Our results suggest that assertive strategies are more effective at suppressing belief than questioning strategies. (shrink)

Wittgenstein’s concepts shed light on the phenomenon of schizophrenia in at least three different ways: with a view to empathy, scientific explanation, or philosophical clarification. I consider two different “positive” wittgensteinian accounts―Campbell’s idea that delusions involve a mechanism of which different framework propositions are parts, Sass’ proposal that the schizophrenic patient can be described as a solipsist, and a Rhodes’ and Gipp’s account, where epistemic aspects of schizophrenia are explained as failures in the ordinary background of certainties. I argue that (...) none of them amounts to empathic-phenomenological understanding, but they provide examples of how philosophical concepts can contribute to scientific explanation, and to philosophical clarification respectively. Graduates' employability indicates the excellent education and relevant preparation they obtained from their respective degrees. Tracer studies have enabled higher education institutions to profile their graduates while also reflecting on the quality of education they provide. With the foregoing, a tracer study determined the demographic and academic profile of teacher education graduates from 2017 to 2020 in a state university in the West Philippines. It also ascertained the advanced studies they attended after college, their employment data, the relevance of college (...) preparation with their current employment, difficulties they encountered while securing employment and in their present job, and recommendations to strengthen the teacher education program. The study utilized a descriptive survey research design with 80 non-random samples chosen based on availability. The survey was based on the Philippine Commission on Higher Education with modifications elucidated from previous studies. Results showed that graduates took the teacher education program with a strong passion for the teaching profession. More graduates received honors and awards, passed the licensure examinations for teachers, attended advanced studies for professional development, and are employable. Besides, the graduates’ college preparation is relevant to their current employment. Further, difficulties and problems encountered and recommendations to strengthen the teacher education program were noted. These findings may serve as a baseline for curriculum review and give suggestions for future tracer studies. (shrink)

Ontology is one strategy for promoting interoperability of heterogeneous data through consistent tagging. An ontology is a controlled structured vocabulary consisting of general terms (such as “cell” or “image” or “tissue” or “microscope”) that form the basis for such tagging. These terms are designed to represent the types of entities in the domain of reality that the ontology has been devised to capture; the terms are provided with logical defi nitions thereby also supporting reasoning over the tagged data. Aim: This (...) paper provides a survey of the biomedical imaging ontologies that have been developed thus far. It outlines the challenges, particularly faced by ontologies in the fields of histopathological imaging and image analysis, and suggests a strategy for addressing these challenges in the example domain of quantitative histopathology imaging. The ultimate goal is to support the multiscale understanding of disease that comes from using interoperable ontologies to integrate imaging data with clinical and genomics data. (shrink)

Two systems of belief change based on paraconsistent logics are introduced in this article by means of AGM-like postulates. The first one, AGMp, is defined over any paraconsistent logic which extends classical logic such that the law of excluded middle holds w.r.t. the paraconsistent negation. The second one, AGMo , is specifically designed for paraconsistent logics known as Logics of Formal Inconsistency (LFIs), which have a formal consistency operator that allows to recover all the classical inferences. Besides the three usual (...) operations over belief sets, namely expansion, contraction and revision (which is obtained from contraction by the Levi identity), the underlying paraconsistent logic allows us to define additional operations involving (non-explosive) contradictions. Thus, it is defined external revision (which is obtained from contraction by the reverse Levi identity), consolidation and semi-revision, all of them over belief sets. It is worth noting that the latter operations, introduced by S. Hansson, involve the temporary acceptance of contradictory beliefs, and so they were originally defined only for belief bases. Unlike to previous proposals in the literature, only defined for specific paraconsistent logics, the present approach can be applied to a general class of paraconsistent logics which are supraclassical, thus preserving the spirit of AGM. Moreover, representation theorems w.r.t. constructions based on selection functions are obtained for all the operations. (shrink)

De uma perspectiva comportamentalista radical, o eu é um repertório verbal complexo, que, como tal, tem uma gênese social. O reconhecimento da origem social do “eu” abre caminho para uma análise política, incluindo uma discussão do pa- pel das relações de poder na constituição do eu. Entretanto, uma concepção radicalmente social do “eu”, como a proposta pelo comportamentalismo, suscita um problema político: se o eu é integralmente produto do ambiente social, de onde viria uma eventual “vontade” de romper com esse (...) sistema? Parece que para reconhecer a possibilidade de ação política transformadora seria preciso preservar uma noção descontextualizada de “eu”. Considerando essa dificuldade, o objetivo deste artigo é propor uma interpretação política da constituição do “eu” no âmbito do comportamentalismo radical, mantendo no horizonte a possibilidade de uma ação política transformadora. Para tanto, destacamos como “eus” oprimidos são tornados submissos, mas também como de certas contingências podem emergir “eus” subversivos, que se opõem a um sistema social opressivo. Esse “eu” subversivo é caracterizado por um repertório de autoconhecimento mais amplo, que inclui a discriminação do papel das relações de poder e do controle promovido por instituições. Concluímos, com isso, que um “eu” socialmente constituído pode ser politicamente ativo. (shrink)

Resumo: A crise na União Europeia e os programas de austeridade subsequentes fizeram emergir uma miríade de movimentos sociais, diversos na sua natureza e nos seus propósitos. O que se pretende aferir neste artigo é a relação e a conexão existentes entre o Estado, o poder económico, a sociedade civil e os movimentos sociais neste contexto específico de crise. Procuraremos, nesta breve abordagem, explanar alguns elementos de originalidade intrínsecos aos movimentos sociais hodiernos, patentes na sua forma de participação e organização, (...) assim como aplicar estas questões teóricas relevantes ao contexto português. A parte empírica, dada a escassez de estudos de caso existentes, será apoiada no último inquérito do European Social Survey, de 2012. Analisando um conjunto de perguntas aí explícitas, podemos compreender, de forma indirecta, algumas das dinâmicas que caracterizam estes movimentos. Abstract: The crisis in the European Union and the subsequent austerity programs have unleashed a myriad of social movements, diverse in its nature and purpose. The purpose of this paper is to assess the relationship and connection between the State, economic power, civil society and social movements in this specific context of crisis. We will try, in this brief approach, to explain some elements of originality intrinsic to modern social movements, evident in their form of participation and organization, as well as to apply these theoretical questions relevant to the Portuguese context. The empirical part, given the paucity of existing case studies, will be supported in the last survey of the European Social Survey of 2012. By analyzing a set of questions explicit there, we can, indirectly, understand some of the dynamics that characterize these movements. (shrink)

A pecuária brasileira tem destaque acentuado quanto a sua participação no produto interno Bruto nacional (PIB), entretanto, dentro da cadeia produtiva das proteínas de origem animal, a ovinocultura ainda se apresenta como uma atividade com pouca expressividade e tecnificação frente a outras espécies animais domésticas, desta forma seu fomento e próspero desenvolvimento é dependente de inúmeros fatores, sendo que destes o correto manejo reprodutivo de espécies , a escolha de raças autóctones ou do exterior com boa adaptabilidade para serem criadas (...) em regiões de clima tropical e subtropical encontrados no Brasil e a correta seleção quanto a características reprodutivas de matrizes e principalmente de jovens carneiros cujos quais se deseja utilizar como reprodutores em rebanhos que buscam a constante evolução produtiva se faz muito importante. Tal cenário traz à tona a importância da realização de estudos referentes a suplementação de elementos como vitaminas e microminerais, que embora não sejam os maiores constituintes das dietas ofertadas aos animais de interesse zootécnico, exercem grande influência não só no crescimento e desenvolvimento do tecido muscular como também podem estar positivamente correlacionados quanto aos aspectos reprodutivos . O presente trabalho objetivou a avaliação da qualidade seminal e morfometria testicular de carneiros púberes submetidos a suplementação injetável de minerais e vitaminas, sendo utilizados 30 reprodutores divididos em três grupos de dez animais cada, com delineamento dos grupos inteiramente casualizado. Ao primeiro grupo foi administrada suplementação vitamínica e mineral (Grupo VM), no segundo grupo houve apenas suplementação vitamínica (Grupo VIT) e no terceiro grupo a suplementação mineral (Grupo MIN). No presente trabalho buscou-se avaliar os efeitos da aplicação de complexo vitamínico e mineral sobre a qualidade do sêmen ovino, medidas morfométricas testiculares e alteração nas concentrações dos hormônios cortisol e testosterona. Palavras chave: elementos-traço, hormônios, nutracêutico, ovinos, sêmen -/- Brazilian livestock has a strong emphasis in terms of its participation in the Gross National Product (GDP), however, within the production chain of animal proteins, sheep farming still presents itself as an activity with little expressiveness and technology compared to other domestic animal species. in this way its promotion and development depends on the correct methods, which are the reproductive of sheep species, the choice of indigenous or foreign breeds with good adaptability to be created in tropical and subtropical regions found in Brazil and the correct selection of selected animals and selection of products that are very important for the demand for products of constant breeding. This scenario leads to the development of important studies for the supplementation of such vitamins and trace minerals, which, although not the largest components of diets, exert a great influence not only on the growth of muscle tissues but can also be positively correlated with their reproductive aspects. The present evaluation of seminal quality and testicular morphometric of pubertal animals includes an injectable supplement of vitamins and minerals, using 30 sires distributed in three groups of animals each, with a completely random design of the products. The first supplementary group was given the mineral supplement (VM Group) in the second group only vitamin supplementation (VM Group) and the mineral supplementation group (MIN Group). This article develops a view of shape representation both in visual experience and in subpersonal visual processing. The view is that, in both cases, shape is represented in a ‘layered’ manner: an object is represented as having multiple shape properties, and these properties have varying degrees of abstraction. I argue that this view is supported both by the facts about visual phenomenology and by a large collection of evidence in perceptual psychology. Such evidence is provided by studies of shape discriminability, (...) apparent motion, multiple-object tracking, and structure-from-motion. There is a curious phenomenon where people from marginalized populations are taken to be arrogant when they show no signs of superiority. In effect, their actions are misconstrued, and their attitudes are rendered unintelligible. Given that arrogance is standardly taken to be a flaw in one’s moral character, understanding such misattributions should give us insight into the affective marginalization many people face. This talk aims to give a thorough exploration of arrogance under oppression. I argue that arrogance is a kind (...) of self-preoccupation that involves projecting one’s values, goals, and concerns onto others as if they were objective values, goals, and concerns. When the affectively marginalized communicate their self-respect through things like protest, people mistake that self-respect as self-preoccupation given how the affectively marginalized are constructed. Furthermore, given how affective marginalization not only inhibits how the marginalized are understood by others, but inhibits their own affective lives, I argue that taking up an arrogant attitude is not always morally vicious, but can be a beautiful form of political resistance but all things considered good. La educación es siempre, por su misma naturaleza, transformadora. Transforma vidas, transforma realidades, transforma culturas y civilizaciones y todo ello a partir del hecho básico inicial de que dicha transformación comienza por ser la de sus propios actores: educadores y educandos. Es válida, en relación con ello, la afirmación del filósofo Gadamer (2000) acerca de que “educar es educarse”, pues en la educación “de lo que se trata –dice el autor, parafraseando a Hegel-- es de que el hombre acceda él (...) mismo a su morada”: acceder a la morada en el mundo es para la persona abrir el camino a ese espacio en el que se siente bien, donde es feliz. Desde esta perspectiva, el ejercicio de educarse es, para educadores y estudiantes en primer término pero con proyección a la sociedad entera, un ejercicio compartido de diálogo, involucramiento y enriquecimiento mutuo mediante el cual asumen el desafío de impulsar sus vidas hacia la plenitud personal, en armonía con la construcción de felicidad social. En tiempos en los que predominan formas de educación orientadas al éxito, a ser competitivo y poseer habilidades avanzadas para interactuar con las máquinas, o bien –en algunas perspectivas psicológicas-- solamente para adaptarse y no sufrir, según Gadamer (2000) “si lo que uno quiere es educarse y formarse, es de fuerzas humanas de lo que se trata y sólo si lo conseguimos sobreviviremos indemnes a la tecnología y al ser de la máquina” (p. 48) o, agregaríamos, a la ilusión de refugiarnos en islas de bienestar individual que nos aíslan de la comunidad y del entorno. Esas fuerzas humanas de las que habla el filósofo son las que pueden impulsar una educación basada en la capacidad de aprender a ser felices a lo largo de toda la vida. (shrink)

Se estudia, con fines académicos, el proceso penal de única instancia o de jurisdicción privilegiada, ante la Suprema Corte de Justicia (SCJ) de República Dominicana, previsto en el artículo 154.1 de la Constitución dominicana de forma expresa con el objetivo de asegurar el funcionamiento de altos cargos del Estado siendo sujetos procesales pasivos aquellos funcionarios públicos investidos de inmunidad o fuero procesal. Para que la SCJ tenga competencia judicial inobjetable y pueda juzgar válidamente, en única instancia, a personas particulares sin (...) dicha prerrogativa procesal, por arrastre o por conexidad de la causa, tiene que estar autorizada expresamente por la ley procesal penal dominicana (que no es el caso) sin que le valga invocar la jurisprudencia interna porque contradice el derecho convencional y desconoce decisiones vinculantes -cosa interpretada de la Corte Interamericana de DDHH. En la presente reflexión, se exponen algunos de los efectos jurídicos y procesales derivados de la Declaración Conjunta de Argyle por el Diálogo y la Paz entre Guyana y Venezuela (Declaración Conjunta, en adelante), publicada en San Vicente y Las Granadinas en fecha 14 de diciembre de 2023. Se analizan, de manera sucinta, las implicaciones procesales que la Declaración Conjunta, asumida como elemento material probatorio, genera a favor de la posición jurídica de Venezuela que puede promover, con base a una (...) serie de hechos nuevos de relevante valor y eficacia procesal, tanto la i) la excepción de inadmisibilidad sobrevenida de la demanda judicial que, por el territorio de la Guayana Esequiba, promueve Guyana contra Venezuela, en la Corte Internacional de Justicia (CIJ) dada la impprocedencia de la misma y ii) la excepción de incompetencia sobrevenida de la CIJ para tramitar y decidir el litigio... Los autores dejan enunciado que, conforme a los Principios Generales del Derecho Internacional, concordados al artículo 52 de la Convención de Viena sobre Derecho de los Tratados y con la Declaración Conjunta de Argyle, es jurídicamente factible que Venezuela, conforme a los Principios el procedimiento de los artículos 65 y 66 ejusdem, promueva la nulidad absoluta retroactiva del Tratado Arbitral de Washington de 1897 y, de manera consecuencial, la nulidad absoluta retroactiva, ya reconocida, del Laudo Arbitral de París de 1899 por la coacción y la agresión y la invasión territorial que sirvieron de contexto y pretexto para su aprobación por parte de Venezuela, como medio para tratar de darle aparente legalidad a la ocupación militar ilegal de nuestro territorio Esequibo por parte del Reino Unido. Se responde, desde la dogmática de la Corte Constitucional colombiana, aduciendo los “criterios de identificación” normativa de los derechos fundamentales centrados en i) su relación de funcionalidad con el logro del contenido normativo de la dignidad humana, ii) su traducción como derechos subjetivos, iii) los “consensos dogmáticos, jurisprudenciales o de derecho internacional, legal y reglamentario sobre su fundamentalidad” y, iv) su exigibilidad -más que su propia justiciabilidad-, como presupuestos jurídicos, reconocimiento y aplicación pragmática constitucional en la esfera de vida de (...) la persona humana y la comunidad política, basados, también, en los pilares conceptuales del llamado Constitucionalismo Humanista. This paper discusses methodological similarities between Collingwood's approach to causation and contemporary manipulability-based views. Firstly, I argue that on both approaches there is a preoccupation with the origin of causal concepts which further connects to the aim of establishing the priority of a certain concept/sense of causation as more fundamental. The significant difference lies in Collingwood's focus on the logical and historical priority (Collingwood's sense I) while in more recent theories the focus has been on psychology (i.e., on different philosophical (...) concepts of causation tested in psychological setting-- Woodward, Waskan, Gijsbers & de Bruin). Secondly, I argue that on both Collingwood's views and contemporary approaches (especially Menzies & Price, Price, but also Woodward) there is an important connection between causation and the agent's perspective. This can be subsumed under what Collingwood identifies as the main presupposition underlying causal thought: the relation between the agent's perceived situation and the agent's desired situation/ goal. More broadly, the recent views on causation under discussion share Collingwood's aim of elucidating the problem of causation through investigating causal knowledge and thus can be integrated with his wider project of addressing metaphysical issues through the means of epistemology. One’s constitution—whether one is generous or miserly, temperate or intemperate, kind or mean, etc.—is beyond one’s control in significant respects. Yet one’s constitution affects how one acts. And how one acts affects one’s moral standing. The counterintuitive inference—the so-called problem of constitutive moral luck—is that one’s moral standing is, to some significant extent, beyond one’s control. This article grants the premises but resists the inference. It argues that one’s constitution should have no net impact on one’s moral standing. While a (...) bad constitution lowers the chance that one will act morally, it offers significant gains to moral standing should that chance materialize. A good constitution increases one’s chance of performing good acts but for correspondingly more modest gains. This effect should smooth out, and possibly eliminate, the expected impact of constitution on moral standing. (shrink)

Se o pintor materializou as suas reflexões e concepções em obra pictórica, o fenomenólogo francês dissertou na escrita filosófica o resultado da sua reflexão. Da análise conjunta entre um e outro resulta esta fenomenologia e estética comparativa que apresenta alguns conceitos fundamentais que alimentaram essas reflexões, tais como a visibilidade, o corpo, o mundo. From the joint analysis between one and the other, this phenomenology and comparative aesthetics results, which presents some fundamental concepts that fed these reflections such as visibility, the body, the world. The world of entrepreneurship has historically been linked with taking risks and the potential for significant rewards. However, there persists a notable gender imbalance in the entrepreneurial landscape, wherein women entrepreneurs remain a minority. Women navigating the entrepreneurial path encounter distinct challenges, setting their experiences apart from their male counterparts. In Balayan, Batangas, despite strides towards gender equality, women entrepreneurs continue to face challenges in the entrepreneurial landscape. This qualitative study delves into the experiences of 10 successful female entrepreneurs who (...) met specific criteria. Accordingly, semi-structured interviews are conducted, exploring various aspects of participants' experiences and revealing their motivations, achievements, challenges, and strategies. Thematic analysis reveals the connection between familial, community-driven, and personal motivations that drive these entrepreneurs forward. Despite facing obstacles such as financial constraints and gender biases, they prioritize financial gains and personal growth. In this article, I examine the moral dimensions of gender affirmation. I argue that the moral value of gender affirmation is rooted in what Iris Murdoch called loving attention. Loving attention is central to the moral value of gender affirmation because such affirmation is otherwise too fragile or insincere to have such value. Moral reasons to engage in acts that gender affirm derive from the commitment to give and express loving attention to trans people as a way of challenging their (...) marginalization. In the latter part of the paper, I will discuss how my arguments bear on recent arguments by Robin Dembroff and Daniel Wodak (2018) on the use of gender-neutral language. They argue that we have a duty not to use gender-specific pronouns for anyone. Their conclusion turns, in part, on a rejection of gender affirmation as a moral duty. The value of gender affirmation, rooted in our moral perception of trans people, should make us skeptical of this conclusion, in favor of a more nuanced and pluralistic approach to the ethics of gendering. In this paper we consider the logics L(i,n) obtained from the (n+1)-valued Lukasiewicz logics L(n+1) by taking the order filter generated by i/n as the set of designated elements. In particular, the conditions of maximality and strong maximality among them are analyzed. We present a very general theorem that provides sufficient conditions for maximality between logics. As a consequence of this theorem, it is shown that L(i,n) is maximal w.r.t. CPL whenever n is prime. Concerning strong maximality (i.e. maximality w.r.t. (...) rules instead of only axioms), we provide algebraic arguments in order to show that the logics L(i,n) are not strongly maximal w.r.t. CPL, even for n prime. Indeed, in such case, we show that there is just one extension between L(i,n) and CPL obtained by adding to L(i,n) a kind of graded explosion rule. Finally, using these results, we show that the logics L(i,n) with n prime and i/n < 1/2 are ideal paraconsistent logics. (shrink)

When we perceive an object, we perceive the object from a perspective. As a consequence of the perspectival nature of perception, when we perceive, say, a circular coin from different angles, there is a respect in which the coin looks circular throughout, but also a respect in which the coin's appearance changes. More generally, perception of shape and size properties has both a constant aspect—an aspect that remains stable across changes in perspective—and a perspectival aspect—an aspect that changes depending on (...) one's perspective on the object. How should we account for the perspectival aspect of spatial perception? We present a framework within which to discuss the perspectival aspect of perception and put forward three desiderata that any account of the perspectival aspect of perception should satisfy. We discuss views on which the perspectival aspect of perception is analyzed in terms of constitutively mind-dependent appearance properties as well as views on which the perspectival aspect of perception is analyzed in terms of representations of mind-independent perspectival properties. There are many explanations for the value of money, but they all seem to depend on things like "trust," "shared fiction," "agreement" or even potentially circular logic like that money's value is based on its usefulness as money. But there is a full process by which money, the desire we feel for it, and even how we end up trading it, can emerge naturally from the dynamics of natural selection and human interaction, with a basis in real value, and happening (...) repeatedly and reliably, even if a group of people all agree that money or precious metals are worthless. The ability to perceive the shapes of things as enduring through changes in how they stimulate our sense organs is vital to our sense of stability in the world. But what sort of capacity is shape constancy, and how is it reflected in perceptual experience? This paper defends a pluralist account of shape constancy: There are multiple kinds of shape constancy centered on geometrical properties at various levels of abstraction, and properties at these various levels feature in the content of (...) perceptual experience, governing patterns of apparent shape similarity. I propose that the varieties of shape constancy are subserved by the syntactic complexity of perceptual shape representations. By assigning discrete constituents to various abstract shape parameters, these representations attune us to the preservation of certain abstract shape properties through changes in more determinate shape properties. Finally, I draw broader lessons concerning the nature and function of perceptual constancy. (shrink)

Logical realism is a view about the metaphysical status of logic. Common to most if not all the views captured by the label ‘logical realism’ is that logical facts are mind- and language-independent. But that does not tell us anything about the nature of logical facts or about our epistemic access to them. The goal of this paper is to outline and systematize the different ways that logical realism could be entertained and to examine some of the challenges that these (...) views face. It will be suggested that logical realism is best understood as a metaphysical view about the logical structure of the world, but this raises an important question: does logical realism collapse into standard metaphysical realism? It will be argued that this result can be accommodated, even if it cannot be altogether avoided. (shrink)

En la presente reflexión, se exponen algunos de los efectos jurídicos y procesales derivados de la Declaración Conjunta de Argyle por el Diálogo y la Paz entre Guyana y Venezuela (Declaración Conjunta, en adelante), publicada en San Vicente y Las Granadinas en fecha 14 de diciembre de 2023. Se analizan, de manera sucinta, las implicaciones procedimentales que la Declaración Conjunta, asumida como elemento material probatorio, genera a favor de la posición jurídica de Venezuela que puede promover, con base a una (...) serie de hechos nuevos de relevante valor y eficacia procesal, tanto la i) la excepción de inadmisibilidad sobrevenida de la demanda judicial que, por el territorio de la Guayana Esequiba, promueve Guyana contra Venezuela, en la Corte Internacional de Justicia (CIJ) dada la improcedencia de la misma y ii) la excepción de incompetencia sobrevenida de la CIJ para tramitar y decidir el litigio... El autor deja simplemente enunciado que, Generales del Derecho Internacional, concordados al artículo 52 de la CVDT y con la Declaración Conjunta de Argyle, es jurídicamente factible que Venezuela, conforme a los Principios el procedimiento de los artículos 65 y 66 ejusdem, promueva la nulidad absoluta retroactiva del Tratado Arbitral de Washington de 1897 y, de manera consecuencial, la nulidad absoluta retroactiva, ya reconocida, del Laudo Arbitral de París de 1899 por la coacción y la agresión y la invasión territorial que sirvieron de contexto y pretexto para su aprobación por parte de Venezuela, como medio para tratar de darle aparente legalidad a la ocupación militar ilegal de nuestro territorio Esequibo por parte del Reino Unido. Shedding light on the political power and oppressive potential of language, theories of illocutionary silencing and discursive injustice show how gender, class and race can shape the pragmatics of speech, limiting in some circumstances the speaker’s ability to do things with her words. This article takes a close look at discursive injustice in trials for gender-based violence in connection with the phenomenon of misogyny. It argues that in the courtroom the testimony of the complainant is sometimes silenced by a sexist (...) ideology used in service of misogynistic ends. In particular, it argues that sexist social meanings can sometimes be enacted by the judge and accommodated by prosecutors, figuring as a component of the score in the language game of the trial and thus 1) determining what counts as sexual violence and 2) preventing complainants from making the moves they intend to make. Causal closure arguments against interactionist dualism are currently popular amongst physicalists. Such an argument appeals to some principles of the causal closure of the physical, together with certain other premises, to conclude that at least some mental events are identical with physical events. However, it is crucial to the success of any such argument that the physical causal closure principle to which it appeals is neither too strong nor too weak by certain standards. In this paper, it is argued that (...) various forms of naturalistic dualism, of an emergentist character, are consistent with the strongest physical causal closure principles that can plausibly be advocated. It has been claimed that a key difference between ancient and contemporary skepticism is that, unlike the ancient skeptics, contemporary skeptics consider ordinary beliefs to be insulated from skeptical doubt. In the case of metaethics, this issue is related to the following question: what attitude towards ordinary moral thought and discourse should one adopt if one is a moral skeptic? Whereas moral abolitionists claim that one should do away with ordinary moral thought and discourse altogether, moral fictionalists maintain that, given (...) that morality produces practical benefits, one should continue to make moral utterances and have moral thoughts, while at the same time refraining from asserting such utterances and believing such thoughts. Focusing particularly on Mackie’s skeptical stance, the present essay considers whether the view that first-order moral beliefs are unaffected by moral skepticism is defensible, whether moral fictionalism is compatible with moral insulation, and whether contemporary moral skeptics are in general committed to there being insulation between first- and second-order levels.
